CONSUMER RIGHTS – WITHDRAWAL – CANCELLATION AND RETURN CONDITIONS


GENERAL:

  • By placing an order electronically via the website you are using, you are deemed to have accepted the preliminary information form and the distance selling agreement provided to you.
  • Buyers are subject to the provisions of the Consumer Protection Law No. 6502 and the Regulation on Distance Contracts (Official Gazette: 27.11.2014/29188) regarding the sale and delivery of the products they purchase, as well as other applicable laws in force.
  • Shipping costs, including any delivery fees, shall be borne by the buyers.
  • Each purchased product will be delivered to the person and/or entity at the address indicated by the buyer within a legal period not exceeding 30 days. If the product is not delivered within this period, the buyer may terminate the contract.
  • The purchased product must be delivered complete, in accordance with the qualities specified in the order, and accompanied by any warranty documents, user manuals, or other relevant documents.
  • If it becomes impossible to sell the purchased product, the seller must notify the buyer in writing within 3 days of learning of this situation. The total amount must be refunded to the buyer within 14 days.


IF THE PURCHASE PRICE OF THE PRODUCT IS NOT PAID:

  • If the buyer fails to pay the price of the purchased product or if the payment is canceled in the bank records, the seller's obligation to deliver the product shall cease.


PURCHASES MADE WITH UNAUTHORIZED USE OF A CREDIT CARD:

  • If, after the product has been delivered, it is determined that the credit card used by the Buyer was used fraudulently by unauthorized persons and the price of the product sold is not paid to the Seller by the relevant bank or financial institution, the Buyer must return the product subject to the contract to the Seller within 3 days, with the shipping costs borne by the Seller.


IF THE PRODUCT CANNOT BE DELIVERED WITHIN THE SPECIFIED TIME DUE TO UNFORESEEN CIRCUMSTANCES:

  • If unforeseeable circumstances beyond the Seller's control prevent the product from being delivered within the specified timeframe, the Buyer will be notified. The Buyer may request the cancellation of the order, replacement of the product with a similar one, or postponement of delivery until the obstacle is removed. If the Buyer cancels the order, the payment made in cash will be refunded to the Buyer within 14 days of cancellation. If the Buyer has made the payment by credit card and cancels the order, the product price will be refunded to the bank within 14 days of the cancellation, but it may take 2-3 weeks for the bank to transfer the amount to the Buyer's account.

THE BUYER'S OBLIGATION TO INSPECT THE PRODUCT:

  • The buyer shall inspect the goods/services subject to the contract before accepting delivery; they shall not accept delivery of damaged or defective goods/services such as those that are dented, broken, or have torn packaging, etc., from the shipping company. The goods/services accepted shall be deemed to be undamaged and in good condition. The buyer is obligated to carefully protect the goods/services after delivery. If the right of withdrawal is exercised, the goods/services must not be used. The invoice must be returned along with the product.

RIGHT OF WITHDRAWAL:

  • The BUYER may exercise the right to withdraw from the contract by rejecting the goods without assuming any legal or criminal liability and without providing any justification, provided that the BUYER notifies the SELLER within 14 (fourteen) days from the date of delivery of the product to the BUYER or the person/entity at the address indicated by the BUYER, using the contact information provided below.

TERM OF THE RIGHT OF WITHDRAWAL:

  • If the purchased item is a service, the 14-day period begins from the date the contract is signed. In service contracts where the provision of the service has commenced with the consumer's consent before the expiration of the withdrawal period, the right of withdrawal cannot be exercised.
  • The costs arising from the exercise of the right of withdrawal shall be borne by the SELLER.
  • To exercise the right of withdrawal, the BUYER must notify the SELLER in writing via registered mail, fax, or email within 14 (fourteen) days and the product must not have been used in accordance with the provisions of the “Products for which the Right of Withdrawal Cannot Be Exercised” section of this contract.


EXERCISE OF THE RIGHT OF WITHDRAWAL:

  • The invoice for the product delivered to a third party or the BUYER (If the invoice for the product to be returned is issued to a company, it must be sent along with the return invoice issued by the company when returning the product. Returns for orders with invoices issued to companies cannot be completed without a RETURN INVOICE.)
  • The return form, the box and packaging of the products to be returned, and any standard accessories must be delivered complete and undamaged.


RETURN CONDITIONS:

  • The SELLER is obligated to refund the total amount and any documents that place the BUYER under debt to the BUYER within 10 days of receiving the cancellation notice and to receive the goods back within 20 days.
  • If the value of the goods decreases due to the BUYER's fault or if the return becomes impossible, the BUYER is obligated to compensate the SELLER for the damages in proportion to the fault. However, the BUYER is not responsible for changes or damages caused by the proper use of the goods or products within the withdrawal period.
  • If the use of the right of withdrawal causes the amount of the campaign organized by the SELLER to fall below the limit, the discount amount benefited from within the scope of the campaign shall be canceled.


PRODUCTS FOR WHICH THE RIGHT OF WITHDRAWAL CANNOT BE EXERCISED:

  • Products prepared at the BUYER's request or specifically for their personal needs and not suitable for return, such as underwear, swimwear, makeup products, single-use items, products prone to rapid deterioration, or products with an expired or expiring shelf life, Products that cannot be returned for health and hygiene reasons once the packaging has been opened by the BUYER after delivery, products that have been mixed with other products after delivery and cannot be separated due to their nature, Goods related to periodicals such as newspapers and magazines, except those provided under a subscription agreement, services performed immediately in an electronic environment or intangible goods delivered immediately to the consumer, and the return of audio or video recordings, books, digital content, software programs, data storage devices, computer consumables, and packaging that has been opened by the BUYER is not possible in accordance with the Regulation. Additionally, the right of withdrawal cannot be exercised for services whose performance has begun with the consumer's consent before the withdrawal period expires, in accordance with the Regulation.
  • Cosmetics and personal care products, underwear, swimwear, books, copyable software and programs, DVDs, VCDs, CDs, and cassettes, as well as stationery supplies (toner, cartridges, ribbons, etc.) may be returned only if their packaging is unopened, unused, undamaged, and unused.


DEFAULT AND LEGAL CONSEQUENCES

  • If the BUYER defaults on payment made by credit card, they agree, declare, and undertake to pay interest in accordance with the credit card agreement between them and the card-issuing bank and to be liable to the bank. In this case, the relevant bank may take legal action; may demand the expenses incurred and the attorney's fees from the BUYER and, in any case, if the BUYER defaults due to his debt, the BUYER accepts that he will pay the damage and loss incurred by the SELLER due to the delayed performance of the debt.
